Acceptable Use Policy

ArisHost is mindful of the quality of its services. Parallel to this, the management values the reputation of the company. Users of our services are encouraged to be responsible and mindful of their use of our services.

ArisHost does not condone illegal activities nor does it want to infringe on one's right to free speech.

ArisHost will in no way take the place of a Court of Law in the violation of any of the following rules and of governing laws. If a case is filed in court citing the rules herein, ArisHost will be responsible only for the provision of its services and resources.

Thus, the following rules have been defined for the guidance of its users.

1. Opening an Account

  1. ArisHost will accept clients who seek the following services:
    1. Domain registration
    2. Domain transfer
    3. Site Hosting
    4. Email Hosting
    5. Email Alias
    6. Domain Parking
    7. Cron Jobs

      "Cron jobs" are processes that are run automatically at certain times, in accordance with a "crontab" file set up by each user.

      While "Cron jobs" are not currently offered by ArisHost, in the event that ArisHost decides to offer "Cron jobs in the future, their use will be subject to the following conditions and restrictions:

      1. The job must not execute more often than every two hours.
      2. The job must generate no greater impact than a CGI script.
      3. The job must be "niced". For details, read about the nice command. The preferred value is 10 or greater.

  2. Applications for accounts at ArisHost will only be accepted provided the following conditions are met:
    1. All required fields of the application form are filled with truthful and correct data
    2. The payment for any paid service/s has been received
    3. ArisHost follows the existing laws on e-commerce and electronic data. Thus, its electronic invoice will serve as proof of the receipt of payment from its clients. In the event that a paper invoice becomes necessary, please contact ArisHost, and we will be happy to provide you with one.

  3. Accounts will be activated when the above conditions have already been met.
2. Content

  1. Netiquette

    Users are urged to follow the rules of Netiquette. In particular, ArisHost prohibits the following:

    1. Spamming

      The use of its services and/or resources for the purpose of sending unsolicited advertising to those who do not have existing business relationships with its users. Similarly, ArisHost will not host sites to which unsolicited email advertising is specifically referencing.

    2. Mail Bombing

      Sending emails to anyone without any serious intent to correspond.

    3. Unauthorized Subscription

      Subscribing someone else's email addresses to an electronic mailing list without the permission of the address owner.

      Address owners must personally subscribe to any ArisHost mailing list. Public posting of one's email address does not constitute having it become public property, nor does it equate to a request for communication.

  2. Abuse of Services

    1. ArisHost prohibits the use of its services and resources for the abuse of the legal rights of other people, particularly in the following manner:

      1. Posting of private information without the permission of the person/s concerned
      2. Infringement of intellectual property rights
      3. Defamation of character
      4. Publication of codes that may be considered deleterious

    2. ArisHost prohibits the use of its service and resources for the abuse of existing laws. These illegal activities include:

      1. Drug Trafficking
      2. Fraud
      3. Gambling
      4. Hacking
        This is defined as messages sent that are intrusive in nature, attempts to circumvent network security and authentication, denial of service attacks, flooding, forging router information, unauthorized access to data, security probes, packet spoofing, ping bombing, ping floods, port scans, smurfs, sniffers, winnuke, and other activities defined as hacking.

      5. Piracy of information, video, music, sound bites, etc.

      6. Pornography including content that may be considered filthy, indecent, lascivious, lewd or obscene with an intention to abuse, annoy, harass or threaten another person. This also includes products that are related to these activities.

        Exceptions to this policy include:

        • Sites providing mere links to other sites that may be deemed pornographic
        • Sites created for educational purposes. These must be governed by educational institutions or related organizations.

      7. Promulgation of Viruses
      8. Stalking
      9. Threats of bodily harm
      10. Trade of illegal products and services
      11. Violation of existing laws on exports and imports
      12. Violation of the Electronic Communications Privacy Act
      13. Violation of the Computer Fraud and Abuse Act

      Users found to be engaged in the above mentioned activities will be promptly investigated and proper action will be taken.

  3. Abuse of Resources

    To protect the users of the services and resources at ArisHost, activities that promote the over-use and abuse of ArisHost's resources are prohibited.

    1. Thus, ArisHost has set the following limits with regard to CGI scripts contained and/or executed on any of ArisHost's resources. Please note that these limits may be enforced by the system at any time or, if not specifically enforced, can be grounds for removal of any CGI script that is found to be in violation. These limits are subject to change and variation as deemed necessary at the sole discretion of ArisHost:

      1. Size of Core files = 0 MB
      2. CPU Time Used - 30 seconds
      3. Data Size - 3 Mb
      4. File Size Created - .5 Mb
      5. Memory Locked - .5 Mb
      6. Number of Open Files - 5
      7. Number of Simultaneous Processes - 8

    2. Furthermore, abuse of ArisHost Resources (not specifically in reference to CGI scripts) can be defined as:

      1. Usage of more than 10% of the server's capacity
      2. Having more than Five (5) concurrent MySQL connections
      3. Using the 'find' command anywhere except in the user's own directories
      4. Sending out mail to more than 25 addresses in one batch, whether sequentially or in parallel. Such batches must "sleep" for at least three seconds between each delivery attempt.
      5. Running your own mailing list software
      6. Running an interactive chat application
      7. Running a banner exchange, remotely accessible Web counter, or any other service that performs CGI services for sites outside of ArisHost's network
      8. The installation or operation of any stand-alone, unattended server-side process (daemons) on ArisHost.com servers is forbidden, except by special arrangement. This SPECIFICALLY includes IRC bots or clients as well as any redirector programs. Use of such a process to accept network connections, for any purpose whatsoever, i s expressly forbidden. Violation of this policy will result in immediate account termination, without warning.

    ArisHost reserves the right to add to this list as deemed necessary at its sole discretion. ArisHost also reserves the right to routinely check on the status of usage by its clients. Sites found to be in violation of the abovementioned rules will be automatically terminated without prior notice.

    ArisHost reserves the right to grant special exceptions on a case-by-case basis, at its sole discretion.

  4. Client Responsiblity

    The clients of ArisHost will be held responsible for any activity and content in their respective sites. Only those who prove that they have fallen victim to hackers may not be held liable. These materials are defined as:

    1. Usernames and passwords as determined by the client. The security of one's password is his/her sole responsibility. A facility to change passwords is available at the site to help manage this.

    2. All materials posted in one's directory are considered the responsibility of the site owner. Those whose content is found to be in violation of the Policies of ArisHost will be held liable. Proper action will be undertaken.

    3. Clients are expected to have minimal understanding of websites and site management. Though this knowledge may vary based on the desired use for a site, each site owner should be familiar with the following:

      1. email-sending, receiving, management
      2. FTP and other appropriate uploading resources
      3. Graphics and graphic editing techniques
      4. HTML
      5. Hyperlinks and hyperlink management
      6. Image mapping
      7. Security protocols
      8. Server environments or the understanding thereof
      9. Sound management
      10. Text and editing thereof
      11. Web publishing and tools for this

    4. Bandwidth and Storage Usage

      1. Use of ArisHost Services herein will constitute agreement that a particular website will not exceed the bandwidth and storage usage limits set out. Please refer to the service contract for details.
      2. In the case that bandwidth or storage space in excess of the agreed upon number of MegaBytes per month is used, ArisHost may, in its sole discretion, assess the site for additional charges, suspension of services, or termination of the Service.
      3. In the event that ArisHost elects to take any corrective action, the client is not entitled to a refund of any unused pre-paid fees.

3. Liabilities and Limitations Thereof

  1. Clients will be held responsible for all activities in their site/s unless it is proven that the site/s has been hacked. Furthermore, ArisHost will comply with all local, state, and federal governmental agencies requesting contact information for the owners of any site(s) found to be in violation of any laws. Similarly, any site that is being investigated by said governmental agencies will be suspended immediately and without prior notice to the client.

  2. ArisHost will not be liable for damage, loss of data inclusive of incidental or consequential damages which may arise from the ArisHost servers going off-line or being unavailable for whatever reason. Subscribers are solely responsible for regularly monitoring and creating backups of their own files, and agree to use ArisHost's resources and infrastructure at their own risk. This service is provided on an "as is" basis without warranties of any kind, either expressed or implied. Neither ArisHost nor its partners make any warranty with respect to any content, information, services, or products provided through, or in conjunction with, this free service.

  3. ArisHost will not be liable for any corruption, deletion or revision of data including consequential or incidental damages from any site within its servers.

  4. ArisHost alone will determine if a site is in violation of these policies. Complaints pertaining to the same may be directed to ArisHost and these incidents will be investigated accordingly. Proper action will be taken based on the results of the investigation. The client is expected to give his/her full cooperation to ArisHost and its employees in these occasions.

  5. ArisHost reserves the right to terminate any account found to be in violation of these policies. If, after an investigation, a site has been found to cause damages to a person or any property, ArisHost will automatically terminate the erring site.

  6. ArisHost reserves the right to withhold any payment made prior to the termination of a site.

  7. ArisHost reserves the right to refuse, cancel or suspend its services at its sole discretion.

  8. ArisHost reserves the right to revise the Acceptable Use Policy when it deems appropriate. Non-enforcement of the policies does not constitute consent on ArisHost's behalf.ArisHost reserves the right to refuse, cancel or suspend its services at its sole discretion.

  9. Here is a partial list of circumstances wherefore ArisHost reserves the right to terminate its services:

    1. End of contract
    2. Violation of its Acceptable Use Policy
    3. The client and/or his/her site has been found to be in violation of existing laws
    4. Mutual agreement between ArisHost and the client for the termination of services

4. Reporting of Abuses and Violations

  1. All abuses and/or violations of the Policies stated herein may be directed to: abuse@arishost.com.

  2. All reported incidents of abuse and/or violation of the Policies will be investigated promptly.
